A retired couple with a Thai condo and UK savings accounts.

The Situation

A British couple in their mid-sixties held a condominium in Ayutthaya and savings in the UK. They had UK wills from 2009 that made no reference to Thai assets. Neither had considered whether their Thai property would pass to the survivor on the death of the first, or what would happen on both deaths.

What We Did

We began with an Estate Plan Outline, which clarified that the condominium title was held in both names. We then prepared Thai wills for each of them covering the Thai property, coordinated with their UK solicitors to ensure the two sets of documents did not conflict, and added letters of wishes for their adult children.

The Outcome

Both received a coordinated set of documents across both jurisdictions, completed in eight weeks. Their children have a clear written record of the position and what the couple wished for each element of the estate.

A Thai-Australian family with property across three countries.

The Situation

A family held residential property in Thailand, a rental property in Melbourne, and a small trading company in Singapore. The adult children lived in different countries. No estate planning of any kind had been done. The parents were concerned about how the estate would be administered across three legal systems after their deaths.

What We Did

Over five months, we prepared Thai wills and powers of attorney, coordinated with an Australian estate lawyer and a Singapore solicitor, assisted with a straightforward holding restructure, and produced a written memorandum addressed to all three children explaining the overall structure in plain terms.

The Outcome

The family now has consistent estate documentation across all three jurisdictions, a holding structure that reduces unnecessary complexity on death, and a family memorandum their children can refer to without needing to consult a lawyer to understand it.

Case Study · Power of Attorney

An elderly client unable to manage property transactions independently.

The Situation

An elderly Thai woman owned land and a house in Ayutthaya. Her health had declined and she was no longer able to attend the Land Department in person to manage her property affairs. Her son, who lived in Bangkok, needed to act on her behalf but had no legal authority to do so.

What We Did

We prepared a power of attorney authorising her son to conduct property transactions on her behalf at the Land Department. Signing was arranged at the client's home. We also prepared a basic will at the same time, as the client had not previously made one and wished to do so while the opportunity was available.

The Outcome

The son was able to manage his mother's property affairs promptly and without a court order. A valid will was also in place. The whole engagement, including the home visit for signing, was completed in under three weeks.
