Common Questions

Questions we are often asked.

Do I need a will if I already have a Thai bank account and property? +

Holding assets in Thailand does not remove the benefit of a properly drafted will. Without one, the distribution of your estate is governed solely by the Civil and Commercial Code, which may not reflect your actual wishes. A will gives you the opportunity to direct how your assets pass and to whom, within the bounds of Thai law.

How long does the process typically take? +

The Estate Plan Outline is usually completed within one to two weeks of our initial conversation. The Mid-Sized Estate Documentation Package typically runs four to six weeks from the first meeting to witnessed signing. The Multi-Jurisdiction Family Estate Programme is structured as a multi-month engagement and is scheduled individually with each client.

Can foreigners hold property and pass it through a Thai will? +

Foreign nationals can hold certain types of property in Thailand and can pass those interests through a properly constructed Thai will. The position varies depending on the nature of the asset — condominium units, long-term lease rights, and business shares are each treated differently under Thai law. We discuss your specific situation during the initial consultation.

What is a power of attorney and when does it matter? +

A power of attorney authorises a named person to act on your behalf during your lifetime. It becomes particularly important if you experience a period of incapacity — illness, absence from Thailand, or other circumstances — during which decisions about your assets or personal affairs may need to be made. Without one, even close family members may find themselves unable to act without a court order.

Do you work with clients outside Ayutthaya province? +

Yes. While our office is based in Phra Nakhon Si Ayutthaya, we work with clients across central Thailand and, for the Multi-Jurisdiction Programme, with families in Bangkok and elsewhere. Initial and review meetings can often be arranged at a convenient location or conducted remotely where that is more practical.

What information should I bring to a first meeting? +

A general sense of your main assets, your family structure, and any existing arrangements is sufficient. You do not need to bring formal documents at the outset. We will work through what is relevant together and identify what supporting papers may be needed at a later stage.
